Welcome to the system of “BSL Clinic,” developed by BSL Clinic Co., Ltd. (“the Company”) to provide medical services via the Application, website, Facebook, Instagram, other online media channels, and various online communication channels provided by the Company. This service is available for job applicants, employees, business partners, clients, service recipients (“patients”), and the general public. It includes the use of still and moving images of patients and organizing activities by the Company (“you”), for your benefit. Please read these Terms and Conditions carefully before using the services.
In addition, this agreement may contain links to the Privacy Notice for job applicants, employees, business partners, clients, service recipients (“patients”), and the general public. The photographs, still and moving images of patients, and activities organized by the Company are considered part of this agreement. By logging into the system, you are deemed to have read, understood, and agreed to abide by the Terms and Conditions of Service.
The Company is responsible for maintaining the accuracy and completeness of account information. If the Company detects unauthorized use of account information or suspects that someone has accessed personal data without authorization, the Company should immediately change the password.
The Company agrees that electronic/internet transactions processed and completed through the website, program, or application created by the Company will be legally binding and enforceable under the Electronic Transactions Act B.E. 2544.
Since the Company provides acne treatment services, it has a target audience under 18 years of age. The Company recommends that service recipients (patients) should be under the guidance and supervision of their parents or guardians before signing up for the services. The Company will send messages via SMS, Line, and video calls to notify the guardians. Therefore, if parents or guardians receive the information sent by the Company, it is recommended that they review and understand the rights and obligations of the service recipients (patients) as outlined in the service terms and Privacy Notice for customers and service recipients.
If parents or guardians receive an SMS, Line message, or video call about the medical consultation and wish to object, they must notify the Company before the identity verification process begins. The service recipients (patients) can self-register and enter their personal information. If the Company detects that the personal data entered during registration is incorrect in a way that may create legal or business risks or cause harm (e.g., underage registration), the Company reserves the right to cancel the registration and suspend access to all services. Legal action may be taken in such cases.
Using the services must comply with these Terms and Conditions, including the methods and conditions specified by the Company on the website. The Company can only begin providing services once registration is completed and the Terms and Conditions of Service are accepted. Any references to actions and documents processed through the services provided by BSL Clinic Co., Ltd. will be considered the responsibility of the Company.
The Company reserves the right to suspend services if it detects that the service is being used for illegal purposes, to facilitate illegal actions, or if it violates the rights of others, or causes harm to other individuals. The Company may also suspend access if actions harm the security of the computer system or network.
The Company reserves the right to retain personal data in computer systems for at least 5 (five) years from the date the data enters the computer system, in accordance with the Computer Crime Act (No. 2) B.E. 2560. The Company is not responsible for any service interruptions due to unforeseen events, such as computer system failures, data loss, or inability to access or use the services due to third-party actions.
The Company has the authority to review and change the rights to access the services. The decision of the Company is final. In cases of fraud, forgery, or any fraudulent actions aimed at gaining benefits from the services, whether partially or entirely, or if the Company has allowed such actions, the Company reserves the right to deny or revoke the rights, fully or partially, without compensation.
The Company reserves the right to suspend or terminate its account and take necessary actions for the following purposes, without prior notice and without being responsible for any resulting damages:
Unauthorized access or actions violating the copyright terms in this agreement.
Usage that infringes the Company’s rights or negligence that causes damage to the Company.
Spreading viruses, sending spam, intercepting computer traffic data, or hacking the Company’s computer systems.
Attempting unauthorized access to the Company’s or others’ computer systems, or scripting messages that interfere with or harm other members.
The company needs to process personal data in cases where job applicants, employees, business partners, clients, and service recipients (“patients”) or the general public use services from the company. The company requires this data for contract execution and service provision. If you do not wish to provide such personal data to the company, it may prevent the company from performing its duties under the contract properly and/or may lead to complications or incomplete performance of the contract terms between you and the company. In some cases, the company may not be able to provide services due to the need for diagnosis and treatment from a specialized dermatologist. In such cases, the company may need to refuse registration or cancel the benefits related to the company, either partially or entirely (depending on the case), and the company will advise on how to receive appropriate treatment.
However, the company respects your freedom to give consent, and will not impose conditions on consent. The company assures that it will only use the data for the purposes for which you have given consent.
In cases where the company intends to process your personal data in a manner and/or for purposes that are not consistent with what is specified in the Privacy Notice for job applicants, employees, business partners, clients, service recipients (“patients”), the general public, still and moving images of patients, or activities organized by the company, the company will issue additional notices regarding personal data protection and inform you via the website or send you an email to explain the processing of such data.
The text, images, sounds, videos, trademarks, and intellectual property rights displayed in the company’s services (“Intellectual Property”) are the company’s property and are protected by law. Some parts may also be the property of third parties who hold legal ownership. The provision of this service does not transfer any rights to the company’s intellectual property or grant permission to duplicate, reproduce, claim ownership, or use the intellectual property for commercial purposes or other purposes that may harm the company’s business.
You agree to comply with copyright laws by not publicly disseminating, copying, reproducing, modifying, adapting, compiling, selling, offering for sale, renting, offering for rental, publishing content, reverse engineering, or performing any other actions that could harm the copyright holders in a way that seeks commercial gain or benefits improperly, unless expressly authorized in writing by the company and the copyright holder. You also agree not to use automated tools, software, or devices, nor distribute viruses, worms, spyware, computer code files, or programs designed to intentionally or potentially damage or control the company’s systems. The company agrees not to engage in commercial mass emailing or “spamming,” sending advertisements to others’ emails, or posting to newsgroups, chain messages to generate excessive responses, or sending repetitive messages to others, including any actions that burden the company’s server for service provision.
The company reserves the right to change, suspend, or cancel any content on the website or services, either in whole or in part, at any time. These terms may be modified due to new technologies or the enactment of new laws. Therefore, please check these terms from time to time when using the company’s services. The company will inform you if significant changes occur and will seek your consent when necessary.
Any disputes arising from these Terms and Conditions of Service will be governed by Thai law and the jurisdiction of Thai courts, without regard to conflict-of-law principles. Additionally, if any part of these terms conflicts with applicable laws, either currently or in the future, and such part is deemed incomplete, unenforceable, void, or voidable for any reason, that specific part will be considered invalid, but this will not affect the remaining provisions, which will continue to be valid and enforceable under the law.
